(Referred to as "Afkar” ,“Alshaya perfumes” , “we” , “our” , “us") is provided as a service to you (the “Service”) and is intended to allow its users to browse and/or order products and other goods or services (the “Products”). As a user of this Website (referred to as "you” or “your"), you acknowledge that your use of this Website for any reason, including any transactions you make ("use” or “using") is subject to our terms and conditions mentioned below, which without being limited, include other important sections in the website like the Privacy Policy, Shipping & Delivery , Return & Exchange etc. (collectively the “Terms”). A. Registration/Account Eligibility

1. In order to use some of the services or features made available to you on the website you will need to register and create an account on www.alshayaperfumes.com, secured by a unique password (the “Account”, “My Account”). Any Account so created is personal and exclusive to you and is non-transferable to any third party.

2. If you register and create an account, you are a “Registered User”. To be a Register User, you must be 21 years of age and provide information about yourself as requested during the account creation process that is true, accurate, current and complete in all respect.

3. By registering at and using www.alshayaperfums.com , you must be aware that it is your responsibility to maintain the confidentiality of your Account and agree to accept responsibility for all activities that occur under your Account and you must notify AlShaya Perfumes immediately of any breach of security or unauthorized use of your account.

4. Registered User is responsible for keeping his personal information up to date and AlShaya perfumes is not responsible for any mistakes or losses incurred as a result of outdated or incorrect client information.

5. Registered User must be living person intending to purchase or use our services for personal consumption/use or for the gifting of other living persons. Purchases with the intent of re-sale is prohibited.

B. Orders & Purchases

1. All orders are subject to acceptance and availability as well as all conditions set in these Terms & Conditions, and for your information items in your shopping bag are not reserved and may be purchased by other customers.

2. AlShaya Perfumes offers products for sale that are in stock and available for dispatch, however occasionally some items goes out of stock and in this case you may simply choose to register your email address for notification of arrival of the selected item not held in stock.

3. You agree to pay in full the prices for any purchases you make either by credit or debit card (or Knet) concurrent with your online order or by other payment means acceptable to AlShaya Perfumes, including shipping cost or other charges that may be applicable to such orders.

4. We reserve the right at our sole discretion not to accept your order in any of the event such as, but not limited to, we are unable to get authorization for your payment, and the item you ordered cannot be legally shipped to your country of delivery, the item purchased is no longer in stock or some of the items do not meet our quality inspection before shipment or for any reason that AlShaya Perfumes deems that the transaction is not completely bona fide as per these Terms & Conditions.

5. The “confirmation” stage sets out the final details of your orders. Following that, we will send to you a confirmation order email, detailing the products you have ordered. This email is NOT an acceptance of your order, just a confirmation that we have received it.

6. Only actual dispatch of your order constitutes a completion of contract transaction and thus the transaction will have been concluded in Kuwait.

7. Each order placed at any given time is treated as a new and separate order subject to all Terms & Conditions.

8. From time to time there may be errors in the pricing of the products that appear on the Website or during the order process. There may also be errors in transmission resulting in interruption of your purchase. AlShaya perfumes will in good faith try to resolve any issue that may arise as a result of such errors. You agree to cooperate with AlShaya Perfumes to resolve such issues, and you agree that AlShaya Perfumes shall have full discretion to determine the appropriate resolution in such cases.

C. Pricing Policy

1. Prices shown on the website are in Kuwaiti Dinar (KWD) and exclusive of import duty or taxes. At AlShaya perfumes website you are given an opportunity to select your preferred currency for display purpose only.

2. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion since import duty and tax costs will be invoiced to you directly by our courier agent.

3. If you are a customer whose credit/debit card is not denominated in Kuwaiti Dinar (KWD), the final price will be affected by your financial institution at the exchange rate and commission that is charged by them and for which AlShaya Perfumes is not responsible.

4. Items purchased in a sale or any special promotions are not eligible for further price adjustments in case the same item becomes marked down further.

5. Shipping, duties and taxes are not refundable.

6. We do our best to ensure that the details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfill an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund that full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

D. Payment

1. Payment using a credit card or debit card

We accept Visa, MasterCard and KNet, and any other methods which may be clearly advertised on the Website from time to time.
You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer.
In case your card issuer does not authorize your transaction, we will not be able to prepare your goods for shipment thus incurring delays for which we will not be responsible for.
To ensure that your card is not being used without your consent, if you select KNet as your payment method we will direct you to the KNet payment gateway where you will be asked to enter your card details (e.g. card number, expiration date and pin code). Alternatively, if you choose Visa/Master card as your payment method you will directed to the Master Card Internet Gateway service website (MiGS), where you will be required to enter your card details (e.g. card number, expiration date and pin code). We may validate your name, address and other personal information provided by you during the order process against appropriate third party database. By accepting the Terms & Conditions, you consent to such checks being made. In performing these checks, Personal Information provided by you may be disclosed to a registered Credit Reference Agency (KNet or MiGS), which may keep a record of that information. You may note that this is done only to confirm your identity and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the applicable law.
Our website uses Secure Socket Layer (SSL) Technology to safeguard your Personal Information when processing payment, which is the best practice and standard in the industry, however, we are neither responsible nor liable for any third party unauthorized use of your Personal Information or payment method.

2. Payment using a Gift Card

When making a purchase using a Gift Card, simply enter the Gift Card code in the designated field at checkout. Click on “Add code” at checkout. If the order amount exceeds the Gift Card balance, please select the payment method with which you wish to cover the remaining amount. If the Gift card balance exceeds the order amount, you may use the same code for your next purchase. The amount remaining will be available until you credit balance has been used up completely.

3. Payment using a promotion code

When making a purchase using a promotion code, simply enter the promotion code in the designated field at check out. Click on “Add code’”in the last step of the checkout. If the order amount exceeds the promotion code balance, please select the payment method that you wish to cover the amount remaining.

E. E-Gift Cards

1. E-Gift card can be used to purchase any item available on our website except for additional E-Gift card.

2. Gift Cards are non transferable and may not be returned or redeemed for cash.

3. AlShaya perfumes is not liable for delivery of an E-Gift card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.

4. AlShaya Perfumes is not responsible if the E-Gift card is stolen or used without your permission.

5. AlShaya Perfumes reserve the right to cancel an E-Gift card if we deem such action necessary.

6. Promotion codes cannot be applied to the purchase of E-Gift cards.

7. Sales tax and shipping is applicable on any product, purchased with our E-Gift card.

8. The E-Gift card is only valid in countries that we ship to as stated on our website.

9. When purchasing the E-Gift card you may choose between sending it by email immediately or by selecting a specific date up to 24 month in the future.

F. Promotion Code

We may issue Promotion Code that can be redeemed by our Registered Users, subject to the following:

1. Promotion codes are redeemable only at www.alshayaperfumes.com

2. Promotion codes have different time periods of validity and are applicable for purchase of any product available on the website except E-Gift card.

3. Promotion code must be used prior to checkout.

4. Only one promotion code can be used per order. However, it may be noted that multiple product purchased using one promotion code is allowed.

5. Alshayaperfums.com reserve the right to cancel or block the promotion code, if deemed necessary due to legal reasons, for example, in case of misuse of the promotion code.

H. Governing Law

1. Your use of the Website and any purchase by you of any product from AlShaya Perfumes shall be governed by the law of Kuwait, without regard to the conflict of law rules and any dispute between you and AlShaya Perfumes will be resolved exclusively in the courts of Kuwait.

2. If any provision is invalid, nothing in this shall prejudice that validity of the remaining provisions hereof.

3. Al Shaya perfumes is neither responsible nor liable towards any government for any of their resident who use our website illegally or for any duties or tax on shipments shipped.

I. Special Offers

Online special offers, for example discount sales or Buy one get one free, are applicable towards those products that are shown as such on the Website, from time to time. Sale of such products shall be subject to the terms and conditions as shown for those products, on the Website at the time of such sale and also the Terms & Conditions mentioned herein. In the event of any inconsistency being noticed between the terms of such special offers and the Terms & Conditions mentioned herein, AlShaya perfume reserves the right to interpret and clarify any such inconsistency. Any decision made by AlShaya Perfumes in this regard shall be final and binding.

J. Compensation

At our request, you agree to compensate us fully, defend us, and hold us AlShaya Perfumes harmless immediately on demand, its office, directors, agents, affiliates, Licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms & Conditions by you, including the use by any other personas accessing this Website using your internet account caused by your action or inaction.

K. Passing of property and risk

AlShaya perfumes retain legal ownership of the product(s) until full payment has been made and such payment has been received. Legal ownership of the product(s) will immediately revert to AlShaya Perfumes, if payment is refunded to you.

Risk on the product(s) will pass to you upon delivery.

L. Public and Interactive Areas of our Website

We provide interactive service on our website which is Rating & Reviews. By posting any review you agree to be solely responsible for the content of all information you contribute and we are under no obligation to oversees, monitor or moderate any interactive service we provide on our Website, and we expressly exclude all liability for any loss or damage arising from the use of any interactive service by a user, whether the service is moderated or not. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy or reliability of any user contributions. However, we reserve the right, but are not obligated, to monitor our interactive service and to pre-screen, remove refuse to post or alter any user contributions in our sole discretion. We may restrict, suspend or terminate your use of the Website where we believe that there has been a misuse. Your use of such interactive service is at your own risk.

You also grant to Alshaya perfumes the right to use any content you provide for its own purposes including republication in any form or media.  The personal opinions of our users posted in rate & review section are their own and do not necessarily reflect the views of AlShaya Perfumes and we accept no responsibility for any such views.

Personal information that you post on or through the public areas of the Website is generally accessible to, and may be collected and used by others. You should not provide Personal Information about yourself in public or interactive areas of the website such Personal Information is not covered under our Privacy Policy.

M. Shipping & Delivery

Order Processing

1. Most orders are processed within 24-48 hours of receipt.

2. Orders placed on Thursday after 8:00 a.m. & Friday will be processed the following Saturday & Sunday.

3. Orders are shipped and delivered on business day except major holidays (Business days in Kuwait: Sunday through Thursday)

Shipping & Delivery - Kuwait

We deliver within 1-2 business days from the order’s date. Orders placed on Thursday after 8:00 am & Friday will be processed the following Saturday & Sunday.
We deliver anywhere in Kuwait and a 2 KD charge is applicable per order.
Exact delivery time will depend on the accuracy of the delivery address details you provide. You must ensure that you give the correct delivery address that will enable prompt and timely delivery to you and other customers. Therefore, do ensure that you provide the following information: Governrate, Area, Block number, Street number, Building number, contact person, contact persona number.

We like to keep you informed of the status of your delivery and that can be done by visiting My Account page, clicking on order history and the status will be displayed there.

Shipping & Delivery – International

We can deliver to most countries around the world that SkyNet worldwide shipping delivers to in a reasonable time frame, where your package is sent in an adequately protected packaging to ensure safe transit and receipt.

International shipping is calculated based on either volume or weight of the total package being shipped and its destination. The final shipping charges will be displayed at checkout, excluding duties & taxes, for your approve before placing the order. Please note that all international customers are liable to be asked to pay country/state import duties and taxes at the time of delivery of your parcel.

We aim to dispatch your order within 2 working days and deliver your order in a timely manner; we do not guarantee any delivery date or delay and all mentions of delivery dates/periods are based on best estimation. You can track your order by log in at our website then go to "My Account" then choose "My Order Histoty" where you will find a tracking link next to your order number to make your own informed opinion of possible delivery date. AlShaya perfumes will not be liable for any compensation for delivery delays.

Also please note that we cannot deliver shipments to P.O. Boxes and that AlShaya Perfumes cannot ship perfume spray size larger than 30 ml internationally. We thank you for your understanding.

Important notes:

1. All orders require a signature upon receipt and our shipper will not delivery your package without a signature. Delays can also occur due to your unavailability to sign for your package or to pay for the required customs and taxes needed upon delivery.

2. We are not able to re-direct any shipments once they leave our warehouse, so please make sure that you or someone representing you will be available at the address that you first instructed us to ship to.

3. In case that our shipper can’t delivery your package to the address you have given us and has to return the package back to us, the customer will be liable for all expenses incurred including but not limited to duties, taxes, return shipping charges. These expenses will be deducted from any refund.

4. In the case of a gift, proof of signature of the receipt of your gift or their agent also finalizes AlShaya Perfume’s responsibility for your order/transaction.

5. Upon receipt of any package, the customer must check that it has not been tampered with or opened before signing. In the case that the box has been opened or is in poor condition, it is the responsibility of the customer to inspect the contents of the box and reconcile any differences to the invoice included in the package. Customer should then sign for the package noting any discrepancies with our shipper and inform us of by email.

N. Return & Exchange

Return & Exchange – Kuwait

Making a return or exchange is easy. Simply visit our shop in Avenues mall -phase 1- within 5 days of receiving your order. The original receipt must accompany all returns.

Be aware that:

1. We are not able to process the returns of opened merchandise. You may return any unopened products in sellable condition within 5 days of purchase as long as the original receipt accompanies them.

2. Our customized boxes orders cannot be returned or exchanged.

3. If you take the advantage of occasionally special offers or promotion code on your purchase, you will have to exchange the item with the same amount you pay for it, not its original price, also the value of the refund will have the same condition.

4. Delivery fees are not refundable.

Return & Exchange – International

Please note all our products are final sale and may not be returned or exchanged.

However we are willing to replace any defective product(s) for the same product(s), subject to availability if informed and returned within 3 days of receiving it. Shipping, taxes and duties are free on the replacement item(s). The cost of returning the product shall be on the account of purchaser. You will receive a credit note if the item(s) is not available by email and details of how to use it. However we cannot accept returns for any other reasons.

Please contact our customer services to coordinate your exchange of any defective product. Provide your order number, email address and phone number for prompt service.

Please do not send your order back to us before contacting our customer service and receiving an approval notification.
